Depends on the state. In some places, you can be fired for almost any reason. (except legally prohibited ones, such as race, gender, etc.)

Yes he can. But if you're really....really not drunk....and go get all kindsa tests done within a reasonable time period of him claiming you're drunk....you might could do some damage. I would.

You need to be not only "not drinking" but never drinking on the property where you work, or anywhere near it. Whatever time you drink,adjust to your work schedule.
