I am a K9 handler with a local police department. The supplier of our K9s routinely will take them back if they exhibit behavior which is uncharacteristic of the breed. They will attempt to find another dog to replace the one which is being returned. Having said that, our department carries liability insurance for the incidents you just mentioned. A dog purchased for protection will always run the risk of hurting someone. Even with the training, the dogs occasionally bite other officers during arrests. Our officers are aware of this and they are normally in the way when this occurs. Work with the company to see if he or she could be replaced.

Read the fine print. Then get an attorney if you think you should get restitution.
I'm sure you signed some sort of acknowlegement regarding the animal's temperment. If you were not required to sign that acknowlefgement, you may have a leg to stand on but, then there is the l;aw in your state, county and city that can all have bearing on this situation, including animal control enforcement.
If you signed then you most likely can forget it. After all you did know you were purchasing an animal for protection.
Laws in most states say you are responsible for any act your animal commits.

When you say "protection" dog -- what exactly do you mean? Do you mean an attack dog? Cuz if so, he did exactly what he was supposed to do.
Also, you're going to have to closely read the purchase agreement to identify the limits of liability.

maybe your nephew did something to upset your dog and the dog felt he had 2 protect himself hes an animal its not his fault

Take them to small claims court. Make sure you have all of your documentation with you. You may have to have the dog put down.
