The water in the basment bathroom has been bubbling for days, now the basement bathroom shower is full of sewage! Everytime we flush the bathroom upstairs, the water leaks down to the bathroom pipe behid the toilet and shower this water is clear cold water , what is going on?? I had a problem with them this month so I didnt even pay the rent I need to get out of here and am afraid they will keep my security saying we caused it?? There are mice getting in and out of our refigerater I called them and they told us to put poisen down which we have and they ould be bringing us a new refigerater that week it has been three weeks and they have done nothing about the refigerater, I am about to call them about the sewage problem its disquisting the house has so many proplems we even had a electric fire start in the wall! can I get out of this lease a.s.a.p like now??

The refrigerater is a old yellow one from the 70's which can not even keep icecream frozen, when I moved in the place left in a kitchen drwer for us was tons of mice poisen packs, and boxes of roach motels for us to set out, the fire wasnt started from and outlet but was started from and light switch in the living room which was not large enough to handle the track lighting in the room, it was too cheap the fire department told us. I have all my complaints documented I am on section 8 and I contact my worker who in returns contacts the landlord I pay 500 and they pay 475 a month totaling 975.00 I am a good tenant and have been for four years with no troubles until I moved to a new city and have this slum lord for a landlord. they have send him out letters he will come fix the problems the day before or the day of the inspection right before they arrive.

First of all write down the days you called them , have any outside witness the calls, then call your local health department with the sewage the way it is. That is not right. Second take every and any pictures you can to show proof if you have a video , record it when you flush and what happens. When you are involved with renting you really need to prove you case so more prove the better for you. Call you local health department asap. Good Luck

Some good points, but here's the simple, safest and quickest solution. I hate to say it, but call an attorney specializing in tenant law. There are too many details and situations to get into here. Read your rental agreement. By not paying rent, you may have violated the rental agreement regardless of the house problems. If you did not report the problems properly, the landlord may not know they exist. All problems are not automatically the landlords fault or responsibility, by the way . A lawyer will give you a free consultation to learn of you trouble and help you move swiftly to get help. You'll also have protection to get back deposits, if you're entitled. Good luck!

write your landlord a certified letter with your complaints (get notarized locally) and send it to him. Make sure that you demand that these things be fixed in the letter as well. If things aren't fixed, notify the city health commission because it is NOT safe to be in a house with sewage in the basement. You can't prove your complaints in court without proving that you sent letters to your landlord. Also, if you plan to quit paying rent, put the money into an Escrow account... this will prove to the courts that you had good intentions of paying and weren't being a deadbeat. I went through similar crap and if you have any more Q's message me.

call your city code enforcement office immediately! give them all the details. They will send an inspector out right away, and your landlord WILL answer to them. Also get some landlord/tenant legal advice. Lots of attorneys will offer a free, first time consultation. You might be able to get some of your money back from the landlord for the time you've had to live in his sewage/rat trap.

Definitely report it to the city -- usually the department is called something like Code Enforcement. Then, put your complaints about the place in writing and send certified return receipt requested to the landlord. That way they cannot say they didn't know. You might contact a real estate lawyer.

Contact your State Attorney General. All states have Slum-lord laws to protect renters.

Make the repairs and keep all receipts...
You can take it off your rent.
Lazy landlords are usually glad they didn't have to lift a finger.
Make sure your first step is to send him notice
of your intentions in writing.
