I feel its really before. You're right...the stalker has already done the damage to the stalkee. I mean once you've (stalkee) have realized or been informed you're being stalked, you quickly become very paranoid. But I guess lawfully innocent till proven guilty.
Plus, a stalker, has mental issues that prevent them from realizing their behavior is wrong or not justified as they may think. Therefore they are already a stalker type.

A person can stalk someone without anyone knowing it. They are a stalker at that point. Now, the police can't classify someone as a stalker until after they have been warned. It doesn't mean that they aren't a stalker, it just means that they might not be.

Before. Because if the person wasn't stalking, it wouldn't have been necessary to warn him/her. If the person continues after having been warned, then they are a stalker without self-control. Thus more dangerous.

A stalker becomes a stalker when he/she has been warned to stay away more then once, calls, sends msgs and watches you day and night.
He/she was even warned by the cops.

A stalker is a stalker whether or not his or her activities are known. To say they are only stalking you after you warn them, is ludicrous. If they're not already stalking you, then what is it you are warning them about???

as one that has been stalked and dealt with the police, I have to say before. by the time I involved the police it had been going on for awhile. I was told by the police that they would consider the previous behavior as part of his pattern.

It depends - if the stalker has done any damage they are liable - maybe only through a civil court rather than criminal but still liable. That includes psychological damage.

Before. If they're always around you, always watching you, and you didn't invite them, you're being stalked, whether you told them to go away or not. If you have to tell them to go away, you're right. They've been stalking you.
