I saw house back in February 2006 in NY with the listing agent for that house however nothing ever happened. Fortunately for me the house is still on the market and I would like to know before I go any further if I would be able to purchase the house with a different agent, I have no contract with that listing agent the only paper I signed was back in February saying I saw the house with the listing agent. Is there any statue of limitations to this agent?

On the other hand if i did not sign anything at all and just saw the house with them do they have any rights to the sale?

Generally the buyers agent could try to gain the commision for up to 3-6 months after the initial showing. After that it is fair game. Go to any other realtor and give them the information on the house ask them to represent you.

You can use any agent you want. Don't bother signing any contracts with any agent. They should represent you without one. The seller still gets commission for the sale, but the buyer's agent gets a little chunk of that, too.

Never ever use the listing agent. Their fiduciary obligation is to the seller NOT you the buyer. Get an agent to represent YOU. Every agent can show property listed by other agents and other offices.
