He's mostly at fault since bicycles should not be on the sidewalk, where I assume is where you were...To determine if he is completely at fault, were you doing anything unusual just before he crashed into you, eg suddenly moving in a different direction, suddenly swinging your arms out, if you were not he is completely at fault.

Sounds like neither of you was watching out for your own welfare and both of you wishes to blame the other.
Stop listening to your ipod while you are walking out near traffic.
Use common sense! Which is more important? Your ipod being plugged into your ears and making you deaf to noises around you, or your bodily safety? Ultimately, if you are killed, it won't matter who's fault it was. THINK!
As for him, that was also a stupid thing to say. Was he listening to an ipod or talking on a cell phone as well? People need to stop blaming everyone else for their own negligence.
Both of you get an "F" for the day in my opinion.

don't look at this in one way..extend your views. He might have be daydreaming or something, maybe had a headache like you did and was listening to his fancy IPOD as well. He probably got on the sidewalk because a car was coming and when he did maybe didn't see you coming so he crashed into you. It was nice of him to atleast ask if you were ok, it wasn't ok of you to respond in such way, you could have just said "yes, I'm ok, thank you for asking" instead of saying what you said. You didn't have to get racist neither, you wouldn't like people to discriminate against you, would you? so when your angry, don't take it out on no one, no matter what! just keep your cool and everything will be cool. Like I've learn from my instructor, before saying anything think about it twice! or even 5 times if you have to. Put yourself in their position, don't lower yourself to no ones level.

You're both at fault... for the little accident. At least this guy had the decency to come see if you are ok... instead of just riding off. And being or not being an American means NOTHING when it comes to pressing charges... and frankly - the only "crime" commited is that of ignorance... YOURS!

well, you say you were on a pedestrian walkway, so if he ran into you it's his fault. bicycles are supposed to obey the same traffic laws as any other vehicle. unless you were actually in a traffic lane then i believe it's completely his fault.
p.s. anyone that claims you shouldn't be listening to your ipod when walking is basically implying that deaf people are incapable of safely walking anywhere near traffic.

When he checked to see if you were all right, you were rude.
A civilized person would have asked after him, too.
Although he was at fault for riding on the sidewalk, he took responsibility by checking that you were OK.
Your rudeness prompted his anger. You have no one but yourself to blame for that.
