at the moment she has custody there are 4 kids altogether one now lives with us cos she threatened to stab him and we are in process of going to court for youngest as new b/f has been hitting them .

It depends on what their situation is. Children are taken to others countries on a regular basis and once it has happened it is very hard to get them back. Seek legal advice ASAP before it is too late. But if she has full custody then she is free to move wherever she wishes to.

It is very sad that some people are happy to take the children away from their other parent - unfortunately not everyone puts their kids first!!

If she has sole custody, yes ,she can.

I took mine to the USA and there was nothing my ex could do about it. This is the problem with men, when they sign over full custody to the mother.They never consider the fact that one day she might want to start afresh in a new country with the children.

No. Threaten to take them to court immediately. Also- they can be advised that if they take the children out of the country without advising the other parent, they can be arrested and convicted for kidnapping.

Well, in that case, you may win custody of the kids....

If she is willing to leave the others behind,it looks as if she is not bothered about the rights and wrongs of things,but it all comes down to what the court ruled when she got custody in the first place,did her give up his parental rights,the right thing would be to ask her solicitor for better advice though

i did, he could have gone to solicitors but it would hav envolved money! also i expect i would have won, i heard of the same situation as mine and the court gave the mother permission to take kids further!
people don't just decide to move abroad they usually have to!
i have full custody! i would also say that actually it has all worked out fine, we live in ireland now we were in england! he visits once a month but has had many mini hols and a 8 day one in summer and another 8 day one coming soon! he could have had more as well, but he didn't invite them on his big holiday!

Doesn't sound kosher to me, he better get in touch with his attorney right away. My ex wanted to take my kids to Croatia "for the summer" but I would only let him take one at a time and I had all kinds of legal paperwork drawn up with the time frames that he could have our son. I also told my son that if there was anything told to him that didn't sound right like they would be staying longer and my son had not heard that this was o.k., directly from me, that he was to go to the nearest US Embassy with a copy of this passport and ask for help. I gave my son a copy of his passport ahead of time and told him to keep it with him at all times, this way, he could prove he was a citizen of the US. Get ahold of a good attorney and good luck!

In a word NO.... your partner has to seek legal advice & he can make her stay in this country. He has as many rights to the children as she does if they were married he could actually keep the children with him & she would have to take him to court to get them back unless she has a residency order in which case its not advisable.......hope you get sorted

No, and if she does, you can go to court and get immediate custody of them!

I suggest that you talk with your lawyer right away about this.

unless they already have something written up in their court papers, he needs to go to a courthouse make a motion to keep the kids in the same state they are living in now.

this just happened to my brother in law. my sister was trying to move with the kids five state away!! my sisters a twit. anyway, he went to court and they set up a hearing and the judge told her she can't take the kids away from their father like that.

it's usually in the divorce/seperation agreement that the one with physical custody cannot move the childeren without the other parent's permission... that's assuming he has some kind of custody, even if it's just legal or visitation rights... so she probably cannot do this, but it just may be in their agreement when they got divorce that she can........
