she made a false police report on me for rape i was never charged can i sue her for slander and defamation

Depends on the state. Most states have immunities from civil suit for any statements made in connection with an official proceeding. This includes statements made in court, to the police, at a legislative hearing, etc. The immunity means that you cannot be sued civilly when you file a false police report.

This does not mean that she cannot be charged CRIMINALLY for filing a false police report. Talk to the D.A. and see if you can convince them to file charges against her.

But as for getting CIVIL damages, you're probably out of luck. Sorry.

Who knew about the charges? Who is likely to know after you sue her? The DA may not have taken the case on the "She said, he said" theory. No way to prove the truth of her allegations beyond a reasonable doubt. Maybe in civil court a jury would believe her, if she cross-complains against you for assault.
It would not be the first time a plaintiff lost a lot of money for bringing an action.

Where you arrested?? Did you suffer any humiliation during this time, loose employment? take these factors into consideration, maybe you where no charged because the da did not feel that he had enough evidence to try and convict you of the alleged crime?.. your question was a little vague hard to give you specific's when dont know the circumstances. I understand your question but there is so much more to your story.. good luck..

You need to talk to an attorney licensed in your jurisdiction. There may be no damages if she only told the police. Also you'll have to prove the statement was false and "not being charged" doesn't do this.

Good luck. She probably doesn't have any money to pay you damages if you do win.

In usa, surely anybody can sue surely anybody for something. although, you have no longer have been given a snowball's risk of prevailing. instead, merely see that your ex will pay your new child help. Paying the optimal on one has no longer something to do with the reality that he legally has to help this one, too.

Yes you can. It will end up in a long drawn out process and you need to make sure that you have all your stuff together cause this could get ugly. You can also make her pay for the court cost of all of this.

Sure you can. You will wish you hadn't though. The most likely result of that lawsuit will be you being charged for that rape.

You can sue for anything and everything. That doesnt necessarily mean you will get anything out of it.
