About a year ago at this time, I was involved in a car accident where I was turning left onto a 2lane road (stop signs, MY turn) and this girl was turning right onto the same road. She tried to beat me and get in my lane. She ran into my car. Long story short, her fault, no questions asked, even says so on the police report. I filed a report and claim with my insurance co. to get $$ to fix my car. I got the $$ and fixed my car. Well, I was trying to chance insurance co. the other day when I found out that apparently this lady called my ins. company claiming to be my 'mom' admitting fault to the accident. I was 19 at the time, and this was at MY college. So now, it's gone on my record as my fault. Now, I just faxed the insurance co. the report, and they are going to investiage because this girl committed serious fraud. What's going to happen from here on out, legal wise and prosecution wise for her?

That sounds strange. Before any insurance company settles a claim they do a thorough investigation. And if there was a police report, they would have that already in the files.
Accidents now show up on both parties driving records regardless of who is at fault. Your new insurance company will investigate to ensure that you weren't at fault before they issue you a policy. Insurance companies communicate through a computer system where all of our driving records are kept.
Its also weird that you would file a claim with your insurance company....unless she was uninsured your insurance company would not pay the claim. They would work with her insurance company, and her insurance company would pay the claim. And her insurance company would not pay the claim if you were at fault. They would defend her.
The adjuster has the final say. And they would never change their decision after the claim is closed. NEVER.
Insurance is really complicated, call that adjuster and speak with him/her personally.

But really insurance companies don't go by what she said. They usually go by the police report. On the police report, there are codes giving one fault. Unless you have the police report codes, then you wouldn't know who the police officer gave blame to. Chances are that because she was making a right and you a left, the officer gave you blame. However, just with the facts you provided, it appears that both of you were at fault.

Good thing you caught that, if its her fault then she should pay, not you. As for her, depending upon what was done, she is liable for whatever money paid out and charges by the police. Also her insurance may or will go up greatly as punishment by the insurer.If your rates went up and that is why your changing insurance companies, check with them, you may not have to change at all. Some insurance companies allow an at fault accident without increasing their rates.

Well, first and foremost, I am surprised that your insurance carrier acted on this based on a verbal testimony versus something in writing. So the facts do not make any sense. That said, I suggest that you protect yourself by providing the authority with sufficient information so they can get to the bottom of this.
