First of all, this person was found NOT GUILTY. So there is NO conviction.

The law is very clear if a person cannot discern between right and wrong at the time of the incident they can be found not by reason of insanity.

If she was sane at the time, the prosecution did a lousy job proving it. Like it or not, the laws of this country are designed not only to punish those that are guilty, but to protect those that are accused. It is not enough to accuse someone. But in today's media heavy world those who are accused are vilified before all the evidence is ever heard.

And unless you watch the entire trial from opening to closing you will never have the full picture of what happened on any case.

I know that nobody is going to agree with what I am about to say but, mrs. diaz was found not guilty by reason of insanity, therefore she didn't serve 3 years in a prison. She served 3 years in a state mental institution. When you are found insane for a crime it means that you did not know what you were doing when you did it. So it is kind of like you didn't really do it at all. It is very hard for people like you and me to understand mental problems and why people with mental problems do what they do. But in the state of Texas if you are found not guilty by reason of insanity you are sent to a high security mental institute and have "Routine Court Dates" for the judge to talk to doctors and get an update on your progress. What good would it do to send a crazy person to Prison if they don't understand what they did wrong. So this way they can get help for their condition and still be a productive part of society. and isn't it punishment enough for her to have to live with the fact that she killed her children for the rest of her life now that she is better. Same thing with Andrea Yates, except Yates killed her 5 children.

Now, you'll probably disagree with me, but if the convicted was mentally unstable or not in the right mind when they did the crime, whatever the crime, I don't think they should be held to the same standards of a murderer who gets off on killing people. Imagine this: would you hold a woman who snaps and stabs the man who abuses her to death to the same standard of a man who gets a high off of strangling women, just to see them suffer?

If she was mentally unstable, now that she is, she deserves to be treated as such. But outright sociopaths and hateful psychopaths aren't the same. In this case, I don't think she should've gotten out, due to the fact that I can't find a sane reason for anyone to do that to any child, so I'd classify that as part of the latter.

I don't know, but this woman didn't serve three years for murdering two children; the jury found her not guilty of murder. Not all homicides are murders.

You have a strange set of values in the USA.
You get less penalties for murder ,rape etc than tax fraud or anything that has to do with money...
