I have recently found out my two daughters have been sexually abused by the same person, we are going through court proceedings. After this is over, do i have grounds for sueing this person, through the misery he has caused both to my children and to my wife and i, i would dearly like to take my family on holiday, just to get away for a little while. Any suggestions. Thanks

What an awful situation. Please accept my sincerest best wishes.

Unfortunately, whilst I realise the urge that you may have to get some closure and recompense for the pain that this person has caused your family, I understand that once criminal proceedings have been completed, if they are successful in that the person is convicted and sentenced, it is not possible to then take out a private prosecution against that person. If the proceedings, heaven forbid, are not successful, then it may be possible to seek a private civil prosecution.

Your best option is to speak with the lawyer that is representing th prosecution at the trial or use Community Legal Services DIrect website at cls-direct.co.uk to find a lawyer near to you who can help. Make sure you ask for a fixed fee initial interview though.

It may also be possible if this person is convicted to claim from the Criminal Injuries Compensation Authority for the distress caused to your daughters. The Police will have details of this or there may be details in your phone book or from the solicitor or Citizens' Advice.

Best wishes to you all. XXX

If your daughters are in the process of the court proceedings, this means it has been going on for quite some time, but you have only just found out about it?. If any damages are awarded I would suggest that you ask for them on behalf of your daughters, they are the ones who have suffered at the hands of this monster, its to the girls he owes a debt to. Im not a lawyer or profess to know the law in this area at all, but, this person may not have any money, there maybe a "victims allowance" your daughters are entitled to.

I think its difficult enough for your daughters to be going through these court proceedings, and you want to put them through more because you are angry. You need to think about what is best for them first. They are having a hard enought time and the chance to get over this mess. Give them the chance to move on by letting it go when this is over. You may have grounds for a civil suit, but you need to ask yourself if its really worth it.

I think you can sue in civil court-remember OJ? For pain and suffering, but unless the person is found guilty--you won't get any money. There is no gurantee you will get money and you don't always get it in a lump sum anyway. I sure hope your daughters are in counseling--if not-dump vacation plans and get them some help-that comes first.

Do I get this right, you want to profit from your daughters anguish, Send them on holiday by all means, but don't expect sympathy from me for trying to get someone else to pay.

Wait until the court case is over and done with, then go round and have a meaningful chat with htis man. Someone once said.

"Revenge is better taken cold."

I think you can sue him. Here in the states you could take him to civil court. However, I hope you have pursued criminal charges against this man.
I am sorry for you and your family.
Best of luck.

If somebody falls on your materials you're in charge and that they are able to sue you for damages, particularly thinking you certainly, purposely located the ice there. i'm sorry. you're incorrect. it is why people carry very own harm assurance. Tobias, it is in certainty stupid if somebody else falls, yet as quickly as you fall on somebody else's materials, it heavily isn't stupid anymore. have faith me! AND sure, the sidewalk happening your front door is your materials, yet you assume public use because of the certainty it finally leads to your doorbell.
