The officail Power of attorney was made in saudi arabia and send to India.But the advocates/Notary people and even the Government Officers in land purchase-sell section say that my father cannot sell the land whih is registered on my name,although I have appointed him as my official Attorney.They all say that I have to be personally present for the sell.
I urgently need to sell the land so that I can finance the downpayment for my new house in India.Kindly guide as I cannot go to India personally for the next 6 months on account of my present Contact.Thanks.

You have to execute the Power of Attorney in the Indian Consulate in Saudi. Please approach the Officials in the Indian Consulate/Embassy and they would guide you as to how to prepare the Power of Attorney which would bear the seal of the Indian Consulate/Embassy and the signature of the authorized official. Then forward that to your father and there just can't be any objections from the Registrar's Office.

Your father , who has got a validly executed power in his favour, is entitled to transact the property. If the authorities are not acting on it, you must pursue the legal remedies. You may appeal to the appellate authority over the refusal of the officer. But, you are saying that even the advocates are also of the view that only you should be personally present. I do not know the reason. Is the power is properly drafted and executed. Take a second opinion from some local legal expert. And some guys in the line of the business will be able to sort out these things.

POWER OF ATTORNEY - the purpose of this document is to do any legal work authorised by the maker in favour of the doer, on behalf of the doer.
Since person may not be present to do some work, he executes power of attorney so that his work may not suffer. Generally it includes all commercial transactions even sale and purchase of the immovable property.
Recently, PUNJAB AND HARYANA HIGH COURT struck down a bye-law of HUDA which was designed to nullify all such attorneys.
In your case also , your father can sell property on your behalf and these officials are harassing yoyour father so that he may do some favour to him. you can approach court to sell ur property.

No it is wrong, you can definetely sell your land if you give a power of attorney duely attested by Indian embassy in saudi arabia with a clear condition of handling sales of the said land
may be the conditions of power of attorney is not clear, please ask for the proper documentation of power of attorney from a learned lawyer

Yes a Power of Attorney signed by you for your father is a legal document that is honored anywhere, as long as the lawyer is legitimate.

You have to come down to India and give a Registered Power of Attorney Document in your father's name, in the concerned Registar or Sub-Registar office, in whose jurisdiction your land falls.. is it clear now....

You can sell your property even the title is in your name. The power of attorney is valid as it is executed in India. If you want exact details please contact me and send a copy of the POA to me. Am practising Advocate in INDIA. I wil do the needful.

No, you are never allowed to forge someone else's signature. If you have power of attorney, you sign your own name, and then write "attorney for ______".

yes they are correct. you must go there personally to sell your property. there is no chance to sell your property without your presence. YOUR FATHER CAN BUY FOR YOU A PROPERTY. BUT CANT SELL.
