I have a emergency restraining order against my husband that expires tomorrow. I have filed a domestic violence order today, however it will not go to the judge until Mon-Tues. Can my husband come and remove vehicles or property within the few days there is no order. He has already drained all the bank accounts and I have no income, he was the sole provider. I need my vehicle to seek employment, however I am not a registered owner, he is. Does anyone know the California Law on this. Can I get an extension on the EPO until the other one is granted?

I am not sure on the legalities but if I were you I would take those things you need and go someplace he can not find you for a couple of days. Remember the worse time to be hurt badly or even murdered is the end of a relationship. Make sure the things you are trying to keep don't get you killed. There are shelters and such to help you just call your women's help division of the state. If you can not get help call the women's YWCA but get out of the paces he can find you until you can properly gage his anger and limitations. If you have children do it for them you must live thru this to even have property to worry about. Be safe and good luck hon.

Beware if ur ex is astute enough he will realize the order has run out and come for his property. He can also get it through divorce settlement in his favor if any property is in his name solely. In which case ur cooked.

He should come with some police to help him remove his things. Under no circumstances should the two of you be alone. Get a witness, and GOOD FOR YOU. Lose the jerk bastard.

yes because there is no order to stop him so he is whithin his legal rights to fo and do whatever
