The landlord has rented out my apt. as of 12/1/06 but still is serving an eviction notice to me knowing i am leaving well before (11/20/06) I gave her notice on 10/25/06. Will this stand in Court?

Yes, but it's kind of a moot point. The landlord is just making sure you're out. In theory, you can serve notice but still end up squatting there and the landlord has little recourse.

It can be construed as a slight insult, but who cares?

Check on local ordinances.
I don't see the point of the eviction notice. Sounds like there might be some confusion over your notice. Can you talk to the Landlord? It's much better to settle it out of court. But I think you are in the right.

legally no, do you have a copy of the notice provided? no and take the notice to an attorney have them check it out. there are certain provisions that must be followed before eviction can be done. let the landlord know you will take the eviction notice to your attorney. the landlord may find themselves in a very bad position.

yes they can. u need 2 act fast. if they get u out due 2 a eviction it'll give u bad credit. U will not be able 2 get another place 4 a while those u might be luck and find 1. But it will be hard. so get out as fast as u can.
