When found guilty by the jury, Scopes was fined $100 by the judge. William Jennings Bryan offered to pay the fine for him.

The case was appealed and overturned. The Tennessee Supreme Court decision is found at Scopes v. State, 152 Tenn. 424, 278 S.W. 57 (Tenn. 1925), The conviction was overturned because the judge had assessed the fine, and under Tennessee law, any fine over $50 must be determined by the jury. The prosecution declined to retry the case.
