Depends on the state that you live in. You don't ever have to stay married to someone you don't want to. If they won't sign then they will have to go in front of a judge and explain why they think you should stay married...note you can not be having sex with your soon to be ex...the judge will see that as a reconcilation and will not grant the divorce. The judge may order you and your spouse into marriage counseling. Just remember that it takes time. If you really want the divorce the judge will grant it! Talk to your lawyer! If your soon to be ex has had an affair you can get a divorce on them grounds...note...even if you are still married if your soon to be ex sleeps with someone else it is still an affair and grounds for divorce! There are a ton of reasons for a divorce to be granted...it just depends on how you filed for the divorce!

Thanks to these new great laws that have been created, your spouse can refuse to sign those papers until pigs fly...you will still get your divorce. What happens, is that you file, have your spouse served, you both have to appear in court, sight your reasons and discuss issues for a separation. This is typically called a "cooling off" period. And it lasts about 30 to 90 days depending on what state you live in. At that hearing, the judge will give you a date to reappear after the trial separation has been concluded and if nothing changes, a divorce is granted whether your spouse wants it or not. I should warn you that if your spouse has valid reasons to not want to divorce, a judge (who has strong family beliefs) may order you to mediation to try and work things through. But, if you are adament about getting this divorce, stand your ground honey, don't waiver or second guess someone else's suggestions on working this out, they aren't the one who has to live with your spouse. Nine times out of ten, mediation doesn't work and the mediator has to send a notice to the judge that mediation was deemed inappropriate for your case. It's not going to be easy and your soon to be ex can drag it out, but the end result is usually the same...you get your divorce, and your freedom back to live again! It all depends on what state that you live in, the laws are all different. In Wisconsin if you don't sign then you go to court. This takes about 6 months to get done becasue ever piece of paper has a filing period. One is 30 days to answer, then another is 60 days etc. You have to get a lawyer, file a financial statement with the court and then the paper work gets started. When it goes to court, you get the divorce and it is totally final and you can remarry 6 months after the court hearing.

It's called contesting and the judge postpones it and the judge can actually make you both go to a marriage counselor if one doesn't want the divorce.I know i was in the same thing,so i thought ,you get more bee's with honey,so i just walked him threw it with sweetness,like we are the best of friends,just not compatible as husband and wife,but we could still try it,just as divorced.After it was granted that day,i never even left the court house with him.I know that sounds bad,but i had and needed to get away from him.I wish you the best on everything you do!Good Luck!

the state I'm in says that if once served you have 30 days to respond if you don't respond the divorce will be granted as stipulated , so by not responding you are agreeing to the original papers filed, and once this is done you can't go back and say but I wanted this or that.the best thing to do is to either agree and sign or contest and obtain an attorney to defend your legal rights.

if your spouse refuses to sign you can still have a legal divorce and get on with your life even of your ex wants to keep what ever you use to have going. i think you can file for incompetent differences.

Nothing, the judge will still give you the divorce anyway. At least that is the way it was in my case. My ex wouldn't sign the papers and I still got my divorce.

Based on my own experiences, and friendly advice:
Basically when you file for a divorce, you are requesting to finalize your marriage. It will be the descretion of the Judge to finalize your marriage...but in order for this to happen...one of the married parties must request it!

The judge will give you a divorce eventually. I wouldn't want to be married to someone that wanted to divorce me. Judges do not like crap like that. It ties up their court system.
