my right ear doesnt work and they are relitively new

Those ones suck. Mine burnt out within 2 months. I just bought some nice SONY ones, and no problems. I don't think apple would replace them however. They make some that LOOK like earbuds but are made by Sony, and they work MUCH MUCH better. No problems after over a year with these sony ones

You can try, but the warranty policy specifically doesn't cover the earbuds, so you'd likely do better to just buy a new pair of earbuds. Getting the free replacement would involve mailing in your entire ipod anyway, which will likely cost nearly as much as a new pair of about the same quality (there are much better headphones than the crappy generic ones)

call them and say there in good condition and say u don't know what happend and that they don't work and u try other headphones and they do work so the origional headphones are defective and they'll say o.k sir just send them in and we'll send u new ones or they might just send them 2 u
