Can my boyfriend be carged with statutory if we dont sleep together and someone else is pressing the charges

The laws are different in every state.

For the most part, if your parents were actually trying to charge him with statutory rape, it looks like a lawyer would have to agree to take on the case and he would probably not do that unless your parents had enough proof. Proof might be if you were pregnant, you or your boyfriend admitted to having sex or any proof that he forced you into doing it.

In some states, other people can report your boyfriend for statutory rape only if your parents knew you two were having sex and they allowed it. That could be a form of child abuse.

Your parents have the ability get a restraining order against your boyfriend if he is older and you are under the age of consent in your state. They don't need any 'proof' that you two are having intercourse to have him charged with other crimes like 'contributing to the delinquency of a minor' or a form of sexual assault. If your parents are trying to separate you two then they can.

Well, if you dont have sex, it can't be statutory rape, although the definition of sex may change from state to state as to whether or not it is limited to intercourse. Some states allow for leinance if the 2 individuals are close in age (19 and 17).

If the law is being broken, anyone can bring charges, not just those involved.

I would suggest checking into more. You can search the web (there are some free legal advise available), or checking the phone book for free lawyer consultations, free state assistance, or even some amily planning clinics may be able to help.

If there is no sexual intercourse, then it doesn't matter who brings the charges. There cannot be statutory rape without sex -- as that is defined by the appopriate state laws....

Note that in some states, simply being in bed together, without both having at least one foot each on the floor, can count as sex for purpose of statutory rape. It's all a matter of how the law is written.

He can only be charged if he in fact has sexual intercourse with you and you are under 18. Normally if the age difference is less than 2 years, then they don't charge. (but they can). Heavy petting is not illegal. I believe oral copulation falls under the statutory rape statue.

Sleep does not constitute sex or rape. If you and your "boyfriend" had sex when you were not asleep you may be a Redneck. If he is
your father, cousin or uncle, you are a Redneck. If you are not of the age of consent
for the state in which you live you and your
boyfriend may be guilty of satatutory rape if
you gave it up for him.

If you are underage and your parents believe you two had sex and he is older than 18 then yes but it doesn't mean it will stick. There has to be proof of the act.

He can be charged with the rape of somebody else... but he can't be convicted of raping you if you don't sleep together and there's proof.

If you're not participating in sexual activity no one can get convicted, but the state an bring charges against anybody. Getting idicted is another matter.

Bottom line...no sexual contact, no problems.

Under age sex is not consensual sex if the one of the couple is over 18 and the other is under 18.

If he is over 18 and you are not, get him to join the military.....I know in the Army it's 16 and over, you can bend it over!
