Although in a lot of cases marijuana is kind of pushed off to the side, in a child custody case I find it very unlikely that they will jut brush it off, as putting your son in a household that will be regularly "stocked" shall we say with marijuana, would place the child in unsuitable living conditions. Just let the judge know of the possibility and it will probably be investigated. I hope everything fares well in your custody battle. Good luck.

it all matters when there is a custody battle every factor is taken into consideration especially who will be around your children oif he were to be sent to there fathers to live,the best way is to get a private investigatoor i have been through all this and it pays off in the end,any small thing you can get if there are any priors and driving offences also his relationships if he has had any with women to proove unstableness you get everything into it,it all makes a difference

If he gets busted the courts will hold it against him. You could ask the court to drug test him and if he has inhaled through second hand smoke it will show up in a test.

best suggestion is to just see what the courts say. file your paper work and write all your concerns in your declaration and bring these facts up to the mediator. seek help from legal aide do not wait. the longer you wait the worst off it is for your babies and you. good luck.
