When this Dr. told me that he will examine my breast,i waited for him to wear gloves and i asked him-"doc,are you not going to wear gloves?"and he replied on me,"don't worry cuz i'm not going to do "internal examination on you".After he examined my breasts,he told me to remove my pants and underwear,and i asked him for the 2nd time why he doesn't wear gloves,and he said he will just take a look at my vagina if there's any infection,but he used his fingers to open and touch my "Lavia".What if he did that to other patient before me and he used that fingers on me?I never saw him washed his hands before and after he touched me on my vagina.What if i get infected?My husband might get infected too.Will i win the case if i'll sue this Dr.?And what if i have infection,and bec. he doesn't practice wearing gloves to protect himself and his patients,they too might get infected.I'm just concerned!

Unlikely as it will be his word against yours.
Didnt you get enough answers with your last question which was very simialr to this (without the breast examination and asking twice!).

A doctor provided a service for you . Why did you not insist on him wearing gloves, why did you let him continue the examination? What harmful event occured because of his negligence? Where there witnessess? These are some of the questions that you will be asked. A lawsuit usually takes up to two years to settle and you would need to find a lawyer that will work pro-bono, unless you can afford to pay out of pocket.They will need solid proof that this happened and not just your work against his.

For malpractice you would need to show that he did something out of the standard of care and that it caused you harm. If you are concerned, call his office to complain. If you are more concerned then file a complaint with the medical board. I think most lawyers would laugh at you, especially if they didn't see a big payday coming out of it. Most doctors reviewing the case might agree that he should have worn gloves, but would think you were just out to get cash by suing someone for something like this. Medical costs in this country are hugely expensive because of frivilous lawsuits like this. We all pay increased medical insurance bills because of it. So regardless if you won or lost the case, we all suffer and pay the bills for it. Only the lawyers win. If there were real damages like he intentionally infected you with something or neglegently did something wrong, it would be different. The responsibility does fall on you though, and that if you weren't comfortable, that you just walked out or stopped him.

I'm not sure that an attorney would except the case. It is not appropriate to touch you w/o a gloved hand on your vagina The breast exam, not necessary. I would file a complaint w/ his office (administrators), him personally& the medical board. I would not return to his office. It's possible but not too likely you would get an infection from that situation. But just incase you do. My advise is to report the situation now. So that you have documentation to go by.

I think to win a case, you have to prove that you have been harmed either physically or mentally.
If you become infected, youmay want to look into it, but mentally would lose in my opinion because you had the option to walk out.
I hope you are not infected and you can move on
If you call an attorney and he wants money up front, forget it, that means he doubts that you can win.

Wait...So you went to a male gyno, you let him touch your breast, touch your lavia with no gloves, and nothing rang an alarm? You didn't think..."Hmmmm...I wonder why a male doc. is touching my vagina with no gloves? Maybe I should leave? It's iffy...you kind of can't prove it. Unless you get other people he's done it to! Believe me! The judge will wonder why you let him. I say sue, but it prob. won't go your way!

Change doctors. There do not seem to be grounds for a legal suit against him. You most likely will not win the case. One word against another never is decided for one of the two.
