Well, read more than just a single statute. Aborting a fetus, pre-viability with the mother's consent is not murder. It's abortion. And that's covered by a different criminal code section.

Each state has its own laws about when abortions can and cannot be performed, and what the requirements are. Murder is a different statute, which only covers living beings who already have independent life and who are not existing solely as an internal part of another person. So, read the law that actually applies to the situation you want to discuss.

Some may want to consider embryos and fetuses to be be human beings from the moment of conception. But neither medical science nor the law does. Until they have been born alive, and can exist on their own as independent living beings, they are not considered legally the same.


Stop twisting the law to justify your religious beleifs. If you don't like the laws, work to change them.

every state so long as the fetus is more than 6 months old and lets not forget that malice aforethough requirement.

if a bad guy attacks a pregnant lady who is pregnant and it kills the fetus that is less than 6 months then it would still be murder. but if the mother gets a voluntary abortion before 6 months it is not.
intent is always a big factor in criminal law.
