I can not pay alot of child support, or anything else? I live with my mom and she needs money, she works but I promised to help her, I left my wife after we had a baby to help my mom and now I wonder if a judge will realize I can not pay to much for my son or ex....what do you think?

Emery,

The Judge doesn't care about your adult mother.

He does care about your Child who cannot care for himself.

Why should your child receive less money because , your mother needs help.

She is an adult. And so are you.

As an adult you are the parent and responsible for the care ,of your child.

And if it is difficult , hard or interferring with your life . Tough.

It only matters that your child is taken care of and if you and your mom have to live in a box, then so be it.

But in all honesty they will base it on a portion of your salary.

And your Ex wife is right to try to get as much as possible from you to care for your child. If she didn't she'd be a BAD mother.

Would you give me a thousand dollars?

No , i doubt it.

And would your mother give a thousand dollars to me .

No, and you wouldn't let her.

why should the mother of your child give away money , when she needs it to care for her innocent child, who is her responsibility and first priority.

She would be a bad mother to do so.

And If it helps make your childs life better why would you not want to make your child #1 on your list. And give up what he / She needs.

And you should have your mom get Social security, Disability, or public assistance.Food Stamps.Heat assistance ECT

This way she can support her self,

Hope you , understand what it is to be a parent and the sacrifices a parent makes, perhaps you should speak to your mother about how she has had to make sacrifices, and what she would do, if she were in your ex-wifes place,

She will probably tell you the same.

Your mother is grown and not sickly. Your responsibility is to your CHILD not your mother, so no the judge won't care.
If your mother can not support herself there are Family Assistance programs to help her out (or your father, or her boyfriend can help her). What it sounds like to me (maybe to a judge also), is a way to try to get out of paying Child Support.
Your wife just had your baby, you didn't think she may need your help?
P.S: If you are old enough to have a wife and baby, you shouldn't be living with your mother anyway.

If you are not making much money at this time, the judge will look at your potential earning capability based on your history. He will then establish a percentage of that income that must go to the child. In my state it is usually 20% for one child.

First of all you should of never left your wife and your baby to go help your mother! Your wife and your baby should have been your first priority! I really doubt it if a judge would consider your case! Due to the fact that you abandon your family!

I just get mad about people trying to figure out ways to lower their child support. Your mother is capable of bringing home income. Your child is not. Be a man and get a second job if that's what you need to do to support your child.

Child support is based on what you make & how many children you have. It is not your responsibility to take care of your mother but it is your responsibility to support your son.

The fact that you actually deserted your wife and child becuase you wanted to take care of your mom sounds like a load of BS to me... you could've done that while you were still taking care of your family. I'd say a judge will see it like that.

the judge is going to say you have a responsibility to your child before anything else. Get off your lazy azz and take care of your kid. You suck!!
