Hey there, my boyfriend's divorce has been in process over a year and their agreement states she cannot move out of the state we live in. He is currently deployed and she went and took the kids back to her home state, and told him that she likes it better there and is going to file another motion to move. She has filed them before and they have been denied. So he is in the Persian Gulf, she has the kids in her home state, what can he do? They have an agreement, she can visit her state but not move there, and the children have to be here when he returns from deployment. I thought I would throw this out there and see if anyone knows what he can do. This is not my battle to fight for him I know. The divorce is not yet final.

Well the problem isn't her being there while he is gone, I understand that completely. The problem is her saying that despite their agreement in court she is going to try and stay, and that is kidnapping. This is their issue but as his girlfriend I thought I would put this out and see if I could get him helpful information. I am not going to court with him, I don't call her, nothing like that. I am just looking for people with similar issues and some resources for him. They agreed to live here. His job is here. And now that he is deployed, she is trying to frustrate him and say she is not coming back. They are adults and made an agreement. So if you have real advice or resources, thank you. I will pass them on to him.

If he's not there, it shouldn't matter where she takes the kids. Fighting over where they're at during that time is just a power play for control freaks. If she doesn't move them back when he returns, then you can worry about it.

ETA: He's still legally married. Why is what his WIFE does your concern?

If he's out of the country, and she has family in her home state, I don't see why it would be a problem. The kids need as much family as possible, and if she has relatives and grandparents there, I think he should let it go for now and talk about it again when he returns. Do what's best for the kids right now. Maybe when he returns, he'll move closer to her so the kids have more family stability.

I don' t know how much he can do until he is back home. Looks like he may have to wait until then unless he has family or someone that can represent the case for him on his behalf.
