I have a friend who is pregnant and she works for a company that has 12 employees. Shes not due until June, but she told him early to ensure that she would have maternity leave. Her boss told her she has 1 week with no pay. She doesnt mind not having the pay, but she is going to need more time than a week. She works in Pennsylvania - does anyone know the labor laws, or a website that could help her out?

well i know the law in the uk is totally different but everyone is entitled to a paid 6 months no matter how mqany people work there or how long get her to ask her ob gyn x

I do know that PA is not a great state to work in regarding pregnancy. They do not have disabiliity for a pregnant woman. However she MAY be entitled to the FMLA. I say MAY because there are requirements for the job she is at. I believe the rules are different for companies with less than 50 employees working on their payroll. I say she finds a new job with more employees to take advantage of the FMLA. It IS possible to find new employment while pregnant. I did in my 4th month and they were fine with me taking maternity leave (10 weeks) and thru NJ i was paid thru the state disability for my time off.

In all 50 states they CANNOT fire you for taking up to a year off from work because you are on maternity/paternity leave. It is illegal. I am not sure if they have to pay her for any certain amount of time but they do have to hold her position for her. Personally i would look for a new Job her boss doesn't sound like the greatest guy to be workin for anyway. Hope this helps =-)

Everywhere in the United States has labor laws. The FMLA (Family Medical Leave of Absence) Program deals with accidents, pregnancys, new parents, and etc. Tell her to look into it, and maybe a new job. What and asshole boss! Best of Wishes, and hope this helped!

She should look into getting short-term disability. Companies with small numbers of employees are not required to give their employees any sort of maternity leave (though they cannot fire them--that is illegal).

She may need to speak to an attorney.

Check out the Family Medical Leave Act and other resources but a lawyer is best qualified.

The FMLA act doesn't cover companies with fewer than 50 employees. Basically she's SOL.

I would call your state dept of labor. That is illegal. Most pregnant women get @ least 6 weeks after delivery to stay home. In Ny state you can collect short term disablity.

all she needs to do is to go to Penn work force office & ask
that is totally illegal 1 wk
the hospital sometimes keep you longer than that after having a baby
she should get her info and wait until she is ready to leave to pass it on to the boss
