I have been paying child support on my daughter for 12 years and have never been behind. I have decided to go back to school and have recently changed jobs and lost HALF of my hourly pay by doing so. The agency told me that it would be 90 days before I could get my order reduced (which I have no problem with). My question is, that if I get a second part time job until next spring to earn some extra money, will they take a percentage of those wages and how much of a percentage? At most I will probably only be working about 20 hours a week at the part time job and not making more than probably 8 bucks an hour.

Each case is different: it depends on the state in which the order was processed, the state in which YOU live (if different), the amount of the support order...

I suggest that you contact the child support division for your state with questions specific to your case. Even though they may not be able to reduce your order right away, they should be able to address your other questions regarding dollar amounts withheld, etc.

Maybe not. When I took my ex-husband back to court, to raise my support (I hadn't had it raised in years, even when I went back to college) he tried to use my overtime as income to lower his support. The Judge stated that since my overtime was on my time, and I was doing it for the extra money for bills and such, that I didn't have to declare it as earned income. My support was based on my yearly income alone, not with the overtime included. I hope this helps.

IF YOU GET A PART TIME JOB WORK FOR CASH THAN IT IS NOT VERIFIABLE INCOME. THATS WHAT MY FRIEND DID IF YOU GET A PART TIME JOB AND HAVE TO PAY TAXES IT WILL BE CALCULATED ON BOTH JOBS.

You would have to report your second job, if you don't they probably won't get you on that check.
