The FEDERAL LAW (http://www.fda.gov/ora/compliance_ref/cpg/cpggenl/cpg170-100.html) is that it is illegal to sell a turtle under 4" in the US unless you have a legitmate educational, scientific, or display purpose for it- OTHER than as pets (or certain other conditions).

Many stores have you sign a document stating that you are using the turtle for legitmate purposes (after all, you will be learning from it and keeping it on display, right?), but they are actually asking you to purjure yourself.

Many states have enacted laws that give the federal law more teeth (the federal law does not impose fines, etc. but some state laws do) but the bottom line is that 2" turtles are illegal for general sales.

The reason turtles with a shell under 4 inches can't be sold is because of so many nests being destroyed. Wild turtle populations were being damaged because people were taking as many babies as they could and just using them to make a profit.

You may see tortoises under 4 inches being sold, but these always come from a breeder with documentation and are not an indigineous (native) species. African spurred tortoises are an example.

Petshops get away with "selling" them, by saying "if you buy the habitat, the turtle is free!"
