a friend is going through a separation and her husband is trying to make her leave the house because the house is in his name only is this legal

he would have to have her legally served with papers --- go to court and the judge would rule in the case --- just because her husband tells her to get out - she doesn't have to unless she has received eviction notice from either the court or the police--- tell her to talk to the magistrate or lawyer about this matter immediately! (I went through the same type of harassment when my ex tried the same thing--- at that time I still lived in North Carolina and the home was only in his name too!)
( * you said he's trying to make her leave the home - if he had any real authority he would of called the police and had your friend evicted.... my answer is based upon my experience in North Carolina --- I do encourage her to seek legal counseling quickly!)

First thing is that she needs to get a lawyer and then she can do what she needs to do. Here is what I would tell here even if she isn't on the note and if they didn't sign anything saying this she needs to stay in the house but in different rooms with NO SEX AT ALL why because if there is sex there isn't a separation and they will have to start all over so if she is wanting to stop this then she can just do that anyway if she is to leave the house and then he can say she left the house on her own well and then he could get the house. she really need a lawyer and they will help her on the money thing. If she has any kids she will do okay.

At least in OK Zandelia is right. If the house is in his name ONLY and she is not mentioned then he has every right to kick her out. Hopefully a few of the utilities are in her name. She stops paying, he has no hot water....

you're wrong jaimester! If the house is his he sure can make her leave. I bet she doesn't have a lease. Was she renting from him?? NO. All he has to do is call the police and ask them to escort her off the property. That's IT

sure get a restrain order just say your in fear of your life! and if she has done any action to show there is fear! my ex did it to me and i owned the trailer yet she got it! and i owned it! took it to court 3 times yet still wouldn't let me have it even when she moved out and homeless people were living in it still couldn't go back
