will there be exceptions to open smoking in amvets, vfw, american legions, where the clubs open to the public

Here's what I found. I'm wondering what constitutes a "private club". Can a bar owner go "private"? I agree with places like Ruby Tuesday going smoke free - that's fine...it is a family place that serves food. However, I don't feel my local hole-in-the-wall bar that doesn't serve food, is a place you'd NEVER take your child, and is full of construction workers coming off work in pickup trucks wearing Carharts should be forced to comply. There should be more exceptions to this rule.

Private clubs if only members are present and if the private club holds a valid D-4 liquor permit. A D-4 liquor permit allows private clubs to serve beer and any intoxicating liquor to its members for consumption while at the club.

Finally! I found some answers:

"PRIVATE CLUB" MEANS A CLUB AS THAT TERM IS DEFINED IN R.C. 4301.01 (B)(13) AND THAT IS ORGANIZED AS NOT FOR PROFIT.

"Club" means a corporation or association of individuals organized in good faith for social, recreational, benevolent, charitable, fraternal, political, patriotic, or athletic purposes, which is the owner, lessor, or occupant of a permanent building or part of a permanent building operated solely for those purposes, membership in which entails the prepayment of regular dues, and includes the place so operated.

I know this is getting lenghty but I found the application for a D-4 permit. It is pretty informative too!

I hated coming abode from being in a pub or club and my clothing smelling badly of cigarette smoke, no matter if I had a cigarette or no longer. i do no longer smoke now and love no longer having to smell like the bottom of an ashtray anymore.

They are exempt


UPDATE: But very interestingly, even though the actual issue itself says they are exempt and doesn't list any stipulations, a news article I read today (Thursday) says that if private clubs have even one paid employee, they are NOT exempt.
