i am under no written contract with her and have no utilities in my name at that residence. it was only temporary and ive got a key but have not been able to enter the apartmentfor almost a week now to get even small necesities like clothing or toothbrush. can she be under defaultof contract with landlord for sub-leasing?

She can't legally hold your belongings, but it sounds like you owe her money even if nothing was in your name. Pay up and be a grown up and then get your crap outta there.

The contract issue isn't really what you should be concerned with, its her theft of your personal items that is a problem for you. If you want them back and don't believe you can talk any sense into her, head down to the magistrate's office and swear out a warrant against her. She has NO right to hold your personal belongings. Meanwhile, make sure you've paid your share of the rent and bills. You'll get your stuff back if she believes shes going to get into trouble for keeping it - and if she does, she will.

If you have a key, why don't you just go in?

Take a policeman with you and he will wait while you get your stuff. If not, go to small claims court with all of your possessions wrote down on a list and documents if you have them or can get them. Like receipts or statements from your parents or whoever you previously lived with saying that you owned the things.

Even if you owe money, she cannot hold your belongings. You have the right to have an officer accompany you to the house to collect your things. If you do owe money, that will have to be taken up in small claims court later. Good luck!

It's possible. But in your case you need to call the police to escort you to the house in question and they will make her give you your property. You can't keep peoples stuff like that. The police will tell her to file a claim in small claims court if she thinks you owe her money. I watch a LOT of peoples court.

Just go in and get your stuff.
