I have a piece of property I wish to sell in greece but I am unable to go there at this time. I live in north carolina. I am willing to give power of attorney to my cousin.

You should contact the Greek Consulate in North Carolina to issue a Power of Attorney for your cousin. You would need the full particulars of your cousin like his ID card Number or Passport Number (a driving licence number is not valid in this case) and make sure that all papers be issued in both English and Greek, to make sure that you will encounter no problems with the different spelling of the names in the two different languages!!!

The Greek Consul has notary authority for Greece and the form signed by the Consul gives power of attorney to your representative as if it was signed in Greece. The Consulate is considered Greek territory. However, the form will only be valid for Greece. If you want it to be valid in the USA, you need to have it notarized in any state where you happen to be present. Usually banks provide free notary services for their clients. They will not notarize a document that is in Greek and they can not read. Also make sure that the document expires after the sale and that your cousin can only represent you on issues about the sale and nothing else, unless you want to give him/her unlimited duration and authority over everything.

The other poster gives a good answer; however, thanks to Greece being an EU member - the process is a lot easier.

A Greek attorney, licensed in Greece, has to draft the Power of Attorney (or POA). The POA must be notarized AND the notary must be notarized by the Secretary of State for NC (or whoever oversees notaries).

Once the NC Secretary of State notarizes the notary's signature, you mail the document to your cousin in Greece - saving yourself a trip to the consulate in Atlanta.

You can't do this with an attorney licensed in the US - you need one who's licensed either in Greece or both.
