Try your local legal aid assoc or find a Paralegal either in the yellow pages or nearby college with a law dept. You really dont need either. Just get the correct forms fron the court clerks office for a petition for a hearing for remodification of child support. Then just collect all evidence you can get stating her income which hopefully is considerable more than it was at the first hearing or this wont do you any good. If you could prove child or drug abuse against her, you could go for custody of him and then the support ends completely .. drastic measure. Child support has become one of the largest complaint areas today in the world so youre not alone. Its just that not much is being done to help fathers who really have trouble making ends meet. If you havent report that you have a new baby that's why it is not reduce here in Texas you will pay child support 20% of your monthly income if you don't have any other kids but if you you you oay only 17.5% also if you provide insurance for him the pay will reduce a little too. But what you can do is go to a child support office and talk with a representative if they are not able to help you then look in your sity or town for legal aid it is free and they will tell you what to do.. You can go directly through your court system. They will go through your wages and what you have to pay out plus they will also see that you have another son. I know that its hard. I have given my sons father a great deal of leniency due to the fact that he now has a wife and 2 other kids to support. So I don't ask for much from him but my son has a great relationship with him and I think that's what is important. Call the child enforcement in your state they will help you get started. Good Luck.

Your child support payment was based on the income you had at the time. Unless your income has gone down, I doubt they will renegotiate or care that you have made another child or your ex is making more money. I think you should just shut up and start practicing birth control.

depends.....where is your child support order coming from?
Child Support Services: go down to the courthouse and reopen the case by filing a modification of support. ask for a packet. make sure you have a copy of the last two months of paystubs with you so you can attach it to the packet. then you will serve it on the Child Support Services and your ex. A hearing date will be established and your income re-evaluated. also make sure as you have joint custody you are getting your percentage of time with your son.
Superior Court with Custody, Visitation, and Support: Go down to the court and file a Modification of Child Support. (btw, if you don't have a case for this to begin with, shame on you. go get one started) Work out the schedule visitation so you have your son 50% of the time and FOLLOW THAT SCHEDULE!!! this allots for you lower your payments and actually help out your ex at the same time. again, submit your paystubs and the amount of people you support. Come up with a workable amount of child support with your income. Judges are very workable if you make the effort to provide for your children.

Go to legal aid..You can get a lawyer for nothing...Then have him petition the family court for a new hearing on your child support..Explain to the judge what you are doing and that you feel you shouldn't have to pay so much...If your wife is making more money than she was when you first went to court they might change it...Good Luck

Honestly, at least in the state on MInnesota, my ex had trouble with his first born .... he was trying to get custody.... However, he and I discovered that it is very hard for the father to do anything once the child support is in effect and everything is said and done. You could try calling the county in which the order is and talk to one of their legal aids... Good Luck!

As long as you have been following all the rules and everything that you have been told by the court and Judge you should be able to get things changed. It is not your fault this happened. talk to the lawyer that gave you the divorce.. Good Luck...
