I deposited a check 5 days ago. the day after deposit the check had cleared.. I withdrew the exact amount of the check the next day. I did not have enough money in my bankat the time to cover the check if it was bad. but they said it cleared and paid me. today my bank wants the money back. they say the check was bad. If the check was bad why would they pay me on it. even if i could not cover it according to balance. i could not take the check to the bank it was drawn from, they do not do that here. you have to have n account with the back to cash a check. and i do not have over draft protection

Ask them to try running the bad check through again. Sometimes they only try once. Have you contacted the person who wrote you a bad check? They are responsible for your check amount and all of the bank fees if this goes to small claims court. Good luck.

Sorry buddy, but you are screwed. That is how the nigerian scam is run........by you depositing a check that is not good, refunding them the difference from whatever amount you get, then keeping the balance. Usually the check bounces a few days later and you are screwed. If you ever think that a check may not be good, or even not sure, I would wait at least a week before withdrawing funds on it, maybe even longer. Contact the person who wrote the check, if they are any decent sort of person they should take of it right away for you, plus your bank charges.

Don't give the money back. Let the bank go after who wrote the bad check.

ask the person who paid you the bad check to repay the amount - plus whatever service charge your bank applied - in CASH (dollar bills and coins are always a sure bet), and deposit it.

knowingly passing an nsf check is a felony..give it to the local sherrif.
