The fact that they AREN'T mentioned in the Constitution leaves the issue open to interpretation. Some people saw a need, decided a local gov. was the solution, and that the Constitution didn't say you couldn't do it, so they created a local gov.

The Bill of Rights says that anything not included in the Constitution is left to the states and "to the people" which includes local communities.

anything not mentioned in the constitution or the bill of rights is up to the States to determine.
