what are my options? I have gon to the bank twice and they say to check every few days to see if this guy has the amount in his account since they can't tell me how much he has in there, I don't want to cash it until they say he has the full amount, what else can I do? I don't want to contact him, since i have already done that, and he hasn't called back, and I don't want to push him then he can terminate the check. what do i do? thank you.

Not viable or legal but you could try taking it out on his hide, ie: destructive measure to get what you want. If you're not willing to do that, try the police. Writing a check you don't have the money for = Fraud. Go for it. It might be just as fun if not more fun than the damaging him part. Just kidding, take it to court.

You can also take it to court yourself, in an attempt to get this gentleman to pay you whatever amount the check was made out for.
Send him a certified letter, stating that you know his funds are insufficient, and would like to give him the opportunity to correct this matter, perhaps by making substantial weekly payments.. otherwise, you will have to pursue the matter and take it to court. Maybe then he will respond.

Take it to the bank and let them know you intend to press charges if it is not good. They should reject it and mark it insufficient funds then you can pursue legal actions. You will probably be entitled to punitive damage because the issuer of the check committed a crime.

if you deposit the check in your account and it comes back non sufficient funds that is a crime. you can then prosecute the person or turn it over to a collection agency. as long as you do not attempt to deposit it and he never has the funds for you to cash it, it is not worth the paper it is written on.

If the amount of the check is over $500.00 it is a felony. Have the bank stamp the check ISF take it to the magistrates office and swear out a warrant. Why not push him he is the one who committed a crime not you.

It is against the law to write a check that you do not have funds for. He has committed a crime and you can try to take him to court.

If it is a lot of money go take hi to court. Even if he does not go you can get a judgement against him and then garnish his wages.

Be careful the law states if you deposit the amount knowing that there is insufficient funds you are also in the wrong and liable for prosecution

Why don't you want to cash it until he has sufficient funds? If he can write you a check that is no good, why should you be so "considerate" of him.

Instead of trying to cash it, try to deposit it...and then press charges and sue him.
