In the event of a govenment audit (EPA, FDA, DEC) what are the manufacturers rights?

A manufacture has the right to demand a written statement from the agency that any proprietary information, methods and/ or processes disclosed/ discovered on a "need to know basis" be held in confidence. It is best to have such a statement pre-prepared, so that the official conducting the audit can merely sign.

Other than the protection of proprietary data, and the right to have a representative accompany the inspectors, there are no rights for the employer, unless he wishes to deny access which will result in a court order; failure to comply leads to a charge of
contempt, and eventually court proceedings, in which the Company has a better than even chance of losing.
