Here's the scenario... there's a brother and sister, right? Now, the brother is smitten with his sister's cousin. Granted, the brother and sister do NOT have the same father. I would like to know if this would be either incest or a huge misunderstanding?
Our insturctor posed this question in class today, and I need to know for credit in class today. Thanx!

If the cousin is the relative of the sister's father and not the sibling's mother, then technically, no. If the two (the cousin and the brother) do not share some of the same DNA, then it is technically not incest.

However, from a general standpoint, it would be. The brother is still technically the cousin's relative, although not genetically. Much like if you had a step brother and sister. They aren't technically blood-related so from a technical standpoint, it isn't incest, but from a general standpoint... most people would agree that the step brother and sister having sexual relations would be incest.

Now, if it were a STEP sister's cousin... that would be a little different. If the siblings shared no DNA, most people would probably not consider it incest. However, that's not the case. The brother and sister still have half of the same DNA, which makes the lines a little more blurry as to what is incest and what isn't.

If they do not have the same father then they could be related by the mother since cousins come from both the mother and the father. Saying that they have different fathers does no stop a cousin from being related to the mother and both kids

If the father isn't the same, then the mother must be the common thread to make them brother and sister. Thus, his sister's cousin, from her mother's side would make it a first cousin to him as well, If it is a cousin from the father's side, it would make no blood realation at all, hence it would not be incest.

Assuming that the cousin is the sister's mother's sister's daughter (did you follow that), then the cousin and the brother share no blood lines. So no, it's not incest.

Did they have the same mother? Was the cousin on the mothers side or fathers?? You left out very important details to answer this question! Sorry

That's a close call. Technically and legally, incest is sexual relations between two family members. Since it is not a blood cousin, I don't see why it would be incest.

No, this is not incest. It wouldn't be incest if it was his direct cousin either. Not in the UK anyway. They're allowed to get married.

They are half-siblings, they don't have the same father, but they do have the same mother; of course you don't mention which side of the family the cousion is from. If the cousion is from the mother's side, it is incest, If the cousion is from the "step-father's" side, it is not incest.
