My brother went and picked up his daughter from dallas. The mother called and told him she was living with a sex offender. What are you going to do about your dauther.

If he is stipulated to stay away from minors, call the cops. If he is on probation or parole, call his po. they will have him arrested. You can't get a court appointed lawyer. But, where I live there are agencies that will help you. They work on a sliding scale.

court appointed lawyer's are appointed by the court to represent defendants who are charged with a crime and are unable to hire an attorney on their own - they may also be required by the judge to repay the court for the attorney fees

your brother could speak with someone at the local Legal Aid office to see if he would qualify for free/low cost legal advice

how old is your brother's child? was the child living with the mother as well as the sex offender?

if the mother has custody, but essentially has asked the father to take over the care of the child and is willing to sign such an agreement, then that is fairly simple
if the mother has custody and for some reason just let the child live with a friend who is a sex offender, then the father could make a report to the local child welfare office and they could investigate whether she endangered the welfare of a minor
if the child is 18 or older and opted on her own to live with the sex offender, then there isn't much the father can do

First of all, I assume that your help has been requested by your brother and his family. You don't give information as to whether the daughter is under age or mature. Is the sex offender someone who has served his time, has been rehabilitated and living a straight life? Is he someone who has not yet been apprehended by the law? If you feel that you need to do this, why not go with your brother to a lawyer who practices in family law. Ask for professional advice before proceeding further. If your niece is a mature and consenting adult, neither you nor your brother may be able to do anything about this matter. Good luck.

I would think that the sex offender would be breaking the law by living with a child. AND that the mother of the little girl should be arrested for allowing it. In Maryland, a little boy was killed by a "friend of the family" that the mother knew was a sex offender. The mother allowed this man to befriend her child. She is now facing charges because she was neglectful in promoting that relationship.

He should call his local dept of social services and report it. They can place the girl with the father to protect her. OR he can call the local courthouse and find out if they have a "pro se" clinic. it is where lawyers come and give free advice and might even take the case. HE NEEDS TO ACT NOW>

your brother needs to call child protective services and tell them that he has been informed that his daughter is staying with a sex offender and wants to take her out of the situation but doesnt have the legal rights too. they will go remove her from the situation and get her her own lawyer that will be working towards what is best for her not what she wants. Also the sex offender might be arrested if he is still on probation or parolle since they arent allowe around children under the age of 18.

I'm going to hope your neighbor has to register with the police department when he gets out. If he doesnt,ask why not. I dont blame you at all for being upset. We held a protest in our area about a known sex offender moving into our neighborhood. They relocated him. Good luck with this.

If your niece is an adult 18 year old, and has no psychological limitation, she may be in relation with whomever she chooses. If she is runaway minor your brother should contact local law enforcement agency to investigate and if law was broken file the charges against sex offender. As far as the daughter is concern i do not know enough information to give advice if she is minor. Parent should always stand behind their children in good and bad.

If you can't find a lawyer, get the biggest guy or couple of guys you know over there and kick his a$$, I would do it but I live in portland, then personally remove the daughter from the house, she would be better off living anywhere else than with a freak.

Calling a lawyer for advice is free. They never tell you that.
Get on the phone and call in your local area all lawyers in the yellow pages.

How old is she? Who all lives in the house? Just her and him, or mom? This is light on details. Age is a huge issue, as is if she is below 18 I would assume mom has custody of her?
