I have had my dog for a year where i live and I never had any problems. Now the housing authorities say I have to move or lose the dog after a year+ The lease says no dogs but almost 200 of the 700+ people who live in this complex have dogs like pits and rotts etc. Is this legal.

i had the same problem a few years back, i found out that after a year or more it is called grandfathered in meaning the animal has been there for along time and now they want you to get rid of the animal, no judge will let them through them out you can look it up on line for the Claus.....on property rights and animals, i won mine in court and they where mad as hell, good luck if they have aloud you to keep the dog for more then a year and and now what you to move , you got them where you want them (grandfathered in ) is what its called.

First I would ask others with dogs if they have received notice.

Next I would ask the landlord to prove that they have asked all others with dogs to move. If not you might be able to threaten discrimination.

I believe that if a landlord customarily and knowingly ignores a lease provision then that provision may be able to be declared null and void. It sounds as if you live in a project of some kind and might not have the money to call a lawyer. Read the fine print on your lease.

Well, of people are getting dogs despite the lease saying NO DOGS, then it is their fault, not the Housing Authority!!!!!!!!!

OF course it is legal!!! That is what the lease is for!!!!!

With "no dogs" in your lease, yes they can ask you to move and evict you if you do not comply.

No, it's not right that they've asked you to move because of the dog especially if so many others have them also. Have any of the others been told they have to move because of their dogs?

in NH if your landlord knows for 3 months or more that you have a dog, unless people are complaining, that can't make you move or get rid of your dog. but, they can refuse to renew your lease. check into tenants rights for your state and town.

If the lease says no dogs, you don't have a leg to stand on, no matter how many people have them. Maybe they are starting to pay attention & clean up, or they have gotten complaints.

a similar thing just happened to me. i got a notice stating get rid of 2 of the 3 ferrets i have or get evicted, get this the land lord didn't say it but his MOTHER did and he was sidding with her. my deal was i moved in with one house sitting another(i asked them if it was cool for 2 months and they said yeah) and the 3rd was a b-day present for my hubbies nephew we were going to keep her just a week( now she is mine our b-days are close together he traded in wanting a GP). in our lease it said pets with permission granted i didn't have permission for asia but that was TOO temporary and last minute(she go to my house like 1 hour before his mom showed up to look at our leaky fridge). but anyway for us it was a big mess the landlord tried to say he never gave permission on ferret 2 but i had written proof and they also tried to say we backed out of the lease(since we just up and moved before getting notice) i had proof i didn't. my lawyer said the note his mom gave me was kind of an early eviction notice. after the landlord heard that i never heard form him agian. but go check it out with a lawyer first it may be harder to fight since it says no dogs on the lease.

If the lease says no dogs, then my friend it is no dogs. They can claim they didnt' realize you had one.

Its not fair but seems legal.
