The police need a warrant to get your medical records without your consent. If a doctor gives up that information without your consent, it cannot be used in a court of law. If you are afraid your rights have been violated get an attorney.

Under HIPPA...the Police do have access to your records if your in custody..or there is a criminal investigation.. if there is some direct link that requires testing ,or some type of lab support (and a time line as to how far/what) they do not have to have your Dr's consent. This does'nt mean that your local Police can just review your medical records just for s&g's.

Policy at the moment is that police can obtain your records with your Doctor's explicit consent, if your details are relevant to a criminal investigation.
Following the completion of NHS computerisation, the controversial policy will be that police have access to all records on any patient on demand from the NHS "data spine". Big Brother stuff!

No one is able to access your medical records without your consent or a court order. WIth the new HIPA act, it is next to impossible to gain access to anyones medical information.

They will need a court order to get the medical records.....you are the only one besides your doctor that can get medical records without going through the court.

Scotland, reckon you'll need either consent of the subject or a JP/ Sheriff's warrant.
