I just broke up with my boyfriend because basically he was a bum. We were together on and off for 2 years. About 1 month before we broke up he had purchased a laptop for my birthday because he had basically ruined my bday. He didn't buy me anything, had hit me, killed my fish and put a hole in my wall. I live on campus at college and the police were called. When they were called he ran. Then he came back 2 days later and felt bad about what he did to me on my bday and bought me the laptop. The laptop was purcahsed through dell with my name listed as the purchaser and receiver. His name is not on the invoice at all but he used his dell credit card to buy it. A month later I broke up with him because I couldn't take it anymore. He now threatens to sue me for the laptop if I don't mail it back to him because he claims I used him and then broke up with him. The invoice even states it was purchased 2 days after my bday so I feel like I shoudn't have to give it back.

The laptop was a gift and I am a college student. With everything that I put up with from him I feel like I shouldn't give him back the laptop. Does he really have a case or is he just trying to get the laptop back?

I'm not worried about his violent tendencies because he is up north now and I am down south.

Give him the stupid laptop back, write it off to some bad decisions on your part, have nothing to do with him again and be grateful he didn't kill you.

he could take you to small claims court. (he might just be trying to scare you) if you have the invoice and receipt, that's good. also, if you have a copy of the police report from that day, that's good. it all goes to validate your side, in case you do have to go before a judge. most judges aren't so stupid, you know. (i mean, despite the occasional idiot and despite what lifetime television network would have you think) he can always try to sue you for it.

personally, i wouldn't give it back. but....i'm very stubborn and like a good fight sometimes. plus...i'm not sure giving it back will end the harrassment or danger to you. it might be good to have a documented hearing between the two of you, to add to the police report. the more documented evidence against this type of guy, the better. it only serves to protect you, if need be. screw him.

It's yours especially since you are listed as the purchaser on the invoice. He can sue you all he wants but no lawyer would take the case. But, is it worth the hassle? I'd be more worried about his violent tendencies.

My own thoughts are NO, he has no case. NOT with your name being on all the paper work. BUT he can always say that it was a loan and thats why he paid for it. And truthfully he sounds like a piece of CHIT. So I wouldn't put it past him to do something like that. BUT you would be very smart to put a restraining order on him. He has hit you and now is harrassing you. Go to court and get the restraining order like YESTERDAY. Good Luck.

He's just trying to get the laptop back.
Your name was listed as the purchaser and receiver, so he can't go with it and change it without you giving him the receipt.
You don't have to get it back it's your choice.

I agree with kingstubborn's answer. Give the laptop back and be thankful you're still in one piece. Besides, if you don't give it back, you'll continually be harrassed and that's not good. It could even escalate to something worse (i.e.; physical) if you don't give it back. This dude sounds like a psycho and it's better to keep him out of your life.

Dare him to sue you . You should win but don't just give it back to him. Just keep an eye out he sounds out there and stop taking back boys that hit you.. Good luck..

It's yours girl..Gifts do not have to be given back.. Plus its in your name.. tell him you are going to counter-sue for pain and suffering and mental distress..

he doesn't have ownership you do it is yours
tell him to sue, you will win
doesn't matter how or why or under what circumstances when ownership changes the matter is final
