I think that ethics are part of evolving society and therefore come from intelligence. Ethics protect the individual and the community. Violence decreases with the acceptance of certain universal ethics, take any list you want but the ethic embodied by the ten commandments are an intelligent way to preserve society; do not kill, steal, lie, etc.

Ethics are a Human construct - they are artificial but also intelligent being a product of the intellect.

They are both. Ethics are a set of standards made by man to control the actions of man - that is an artificial control, but it is intelligent to do so - to protect finances, behaviors, etc.

Your question is very poorly worded: Are you asking if ethics are rational representing matters of fact in the world or are created by man?
There is no answer to this question because it all depends on what moral rule you have in mind AND in what situation. There is no definite answer. Check these books out::

Ethics are limitations to our individual freedom, hence artificial.

These limitations give quality and consistency to our individual freedom, hence intelligent.
