A friend of mine wants to get a divorce in the State of Missouri and they have 2 children. They are 15 and 9. Are they old enough to choose who they want to be with or will the court decide no matter what?

I am sure that the Court will at least consider the children's wishes. But...there are many things that will determine the Court's decision. Parent's history and current ability to provide for the children etc.....

One is old enough I'm not sure about Missouri but in Arkansas i believe its 11 that they can decide for themselves where they go however if the 15 yr old wants to go one place I'm sure that will lean the custody of the other to the same person

Children are liabilities of their parents and have no rights. If the parents ask tell the court to let the children decide than it will be so. Usually children end up with mom.

I'm not up on missouri law but an educated guess would be the 15 yr. old can decide and the 9yr. old cannot.

They take the children's age into consideration but I'm not sure the age they consider but i know they try to have the parents work out some kind of agreement

I think the court will look if who is capable of taking care of the children, if not it's usually the parents who decide who should take the children i'm not sure..............

Unfortunalty until they are 16 I think they have no legal rights. The courts will ask them who they want to live with but they will decide who they are better off with.

the 15 year old if he turns 16 soon might have emancipation possibility but not the 9 year old and no they have no say

not sure there but in oz,kids can decide if they want to live with the other parent at the age of 7.
