My husbands child support was figured and we were told their stepfathers income cannot be used, he has been in their lives for 5 years and their mother doesn't work so she has no income counted for her, why can't they use her husbands?

Because they are't his children and legally it's not his place to support them.

For one the step parent is that STEP parent, not the one who brought the child into this world and by all accounts not responsible for supporting or caring for that child. I myself have had full custody of my son for 5 years, I got custody when he was 8 months. Not received on penny yet!. It is her responsibility to support her child not who ever she is with. Now if she is such a dirt bag that she wont work to avoid child support, well that's just a testament of the poor character she is. can say enough about how low or disgusting of a person they are if they don't take care of their kids!.

Check with your state guidelines for figuring child support. In my state if the mother chooses to not work her income is at least counted as minimum wage. Do an internet search for the guidelines in your state because I am pretty sure it varies from state to state.

Same reason they couldn't use a new wife's income for the mother of the children to draw child support based on because these new spouses did not make these children its not their job to support them

I don't think its fair for a step dad to support kids that are not his! The biological father should support his kids, it's his responsibility. How would you feel if you were the mother and the father doesn't want to support his own kids? Would you ask the new husband to take responsibility?? I wouldn't.

Because the step parent has no legal commitments to have to pay child support. It is upto the biological parent to provide income support.

OMG!...This is the stupidest thing I have ever heard!! Now Why would you (a "Step Parent" also)..expect your husband's EX-Wife's Husband..to pay you & your Husband support for "Your "STEPCHILD"...you know..."a child that is NOT HIS..(or yours!")? Not only are you "Reality Challenged" & "Mentally Impared"! You are also a GREEDY LOSER "STEP MOTHER" who has no right to even ask such a stupid question! ( since YOU ARE ALSO A STEP PARENT!) People like you make me sick! You are like a FUNGUS! NO wonder she Divorced your husband! I feel sorry for your husband too being married to a woman like you!! Pphhhttt!!

the step fathers wages are for the support of the spouse, the biological parents are solely responsible for the financial stability of the children, any thing above and beyond that is all and well but the sole responsibility lies with the original parents.

I have been thru this. They can't use his income to adjust child support because they are not his natural children. However! Centerlink will class them as his as he is the primary provider for your kids. Isn't it funny how 1 govt agency says they are his and another says they are not. Let's say YOU remarried someone who was having trouble paying his child support. Would you think it was fair to have a lien placed on YOUR wages? Kind of gives you a different perspective.
