Here's your KENTUCKY law:

Possession of less than eight ounces of marijuana is a misdemeanor, punishable by up to one year in jail and a fine of up to $500. For subsequent offenses, the penalties increase to 1 - 5 years in jail and a fine of $1,000 - $10,000. Possession of eight ounces or more is considered possession with intent to sell and is charged as trafficking.

Sale or delivery (trafficking) of less than eight ounces is punishable by up to one year in jail and a fine of up to $500. The penalties for sale or delivery of eight ounces or greater are 1 - 5 years in prison and a fine of $1,000 - $10,000. Sale or delivery of five pounds or more is punishable by 5 - 10 years in prison and a fine of $1,000 - $10,000.

Any sale to a minor is punishable by 5 - 10 years in prison and a fine of $1,000 - $10,000 for a first offense, and 10 - 20 years in prison and a fine of $1,000 - $10,000 for a second or subsequent offense.

Any sale within 1,000 feet of a school is punishable by 1 - 5 years in prison and a fine of $1,000 - $10,000.

Cultivation of less than five plants is punishable by up to one year in jail and a fine of up to $500. For subsequent offenses, the penalties increase to 1 - 5 years in prison and a fine of $1,000 - $10,000. For cultivation of five plants or more, the penalties are 1 - 5 years in prison and a fine of $1,000 - $10,000. For subsequent offenses the penalties increase to 5 - 10 years in prison and fines of $1,000 - $10,000.

Possession of paraphernalia is a misdemeanor for the first offense, punishable by up to one year in jail and a fine of up to $500. Subsequent offenses are punishable by 1 - 5 years in prison and a fine of $1,000 - $10,000.

Minors convicted of drug offenses are also subject to suspension of their driver's licenses for one year for the first offense and two years for the second offense.

And then the FEDERAL law:

Possession of marijuana is punishable by up to one year in jail and a minimum fine of $1,000 for a first conviction. For a second conviction, the penalties increase to a 15-day mandatory minimum sentence with a maximum of two years in prison and a fine of up to $2,500. Subsequent convictions carry a 90-day mandatory minimum sentence and a maximum of up to three years in prison and a fine of up to $5,000.

Distribution of a small amount of marijuana, for no remuneration, is treated as possession. Manufacture or distribution of less than 50 kilograms of marijuana is punishable by up to five years in prison and a fine of up to $250,000. For 50 kilograms or more the penalty increases to a possible 20 years in prison and a fine of up to $1,000,000. Manufacture or distribution of 100 kilograms or more carries a penalty of 5 - 40 years in prison and a fine of up to $2,000,000. For 1000 kilograms or more, the penalty increases to 10 years - life in prison and a fine of up to $4,000,000.

Distribution of greater than 5 grams of marijuana to a minor under the age of 21 doubles the possible penalties. Distribution within 1,000 feet of a school, playground, public housing or within 100 feet of a youth center, public pool or video arcade also doubles the possible penalties.

The sale of paraphernalia is punishable by up to three years in prison.

The sentence of death can be carried out on a defendant who has been found guilty of manufacturing, importing or distributing a controlled substance if the act was committed as part of a continuing criminal enterprise – but only if the defendant is (1) the principal administrator, organizer, or leader of the enterprise or is one of several such principal administrators, organizers, or leaders, and (2) the quantity of the controlled substance is 60,000 kilograms or more of a mixture or substance containing a detectable amount of marijuana, or 60,000 or more marijuana plants, or the if the enterprise received more than $20 million in gross receipts during any 12-month period of its existence.


As for who to vote for - it's a bit too late now, but next election, check out some of the pro pot websites. They often list candidate's positions and voting records on marijuana related bills.

No. Each State makes and enforces their own individual drug laws. The federal government has their own drug laws. If you are arrested by a State or local law enforcement officer/detective you will be prosecuted under their laws. If you are arrested by a fed, say DEA, you will be prosecuted under federal law. If the feds ever pass a law that marijuana can be used for medical purposes, which won't happen unless Hillary wins, you will have a good defense under any State prosecution. So, go light up and tell Bill. Hello. Hey, Michael S. I'm a die hard Republican. One thing most of Republicans believe in is that the Fed govt should be smaller and leave it up to the State and local govts to manage their people and turf. If the State wants to legalize marijuana for medical reasons and it is a fair and just law most of us would not have a problem. If the State law is passed to just let idiots get stoned than the Feds should rightfully step in.

dont know about the laws or who to vote for but i think it should be legalized, the only way to beat this so called "war on drugs" is to legalize them.

It's illegal....doing this that are illegal get people into trouble.

I never met a drug addict that didn't start with marijuana....no matter how many times marijuana users say they can control their habit any time they want....they just don't want to control it.

So The drug controls them...and they pay any amount of money to get more...and then more...and then...try something else from the same drug dealer......Choices....and then it chooses them and they.....are addicted!

hell yeah. im trying to choke on some bowls without having to watch my back all the time too. i know in cali you need a prescription. Just find youself a doc. who will prescribe it to you and get it.
