I am closing on a house that is occupied by tenants on a month to month agreement with their current landlord. When we close I plan to give them 30 days to move. But can this notice to vacate be expedited since the tenants are selling drugs. They have not been busted but I live only a few blocks away and know that they are selling. What can I do to get them out sooner after I close. By the way, the current landlord was not ask to give notice in the purchase agreement, and therefore, did not. What legal rights do I have? I live in Illinois.

I would be VERY careful... if they are on a month to month lease you can give them a 30 day notice for no reason. Unless you really have proof that they are selling drugs I would leave that off of there.

Depending on when you are closing, could the current landlord give a 30 day notice that will carry over into your purchase? This may cut some of the time down. Also, you may want to check your state's laws concerning property confication dealing with drugs. Houses, as well as vehicles, can be taken away if drugs are being sold from it, even if it is a rented property and the landlord is not the criminal.

Have you contacted your local Police Dept? If not you should, they will need more than your say so unfortunately. As soon as you close give them the 30 day notice do not hesitate. I had a tenant that was busted for selling Cocaine and we were told by the local cops if we didn't evict them and the cops came back to the house, they could confiscate my home. I gave a 30 day notice and I was surprised, I had no trouble at all. They even left the place in somewhat good condition. But your local police should be able to give you more ideas. Good Luck KG

You should have the current landlord handle this tenant. You should ask a knowledgeable real estate attorney that handles tenant/landlord problems.

If you have a "no drugs" policy on your lease agreement, as far as I know, you can legally evict him. Sometimes, that involves having him require his belongings only with police assistance. Once he is gone from your property for a set amount of time, you may be able to call the property legally "abandoned", but you will have to check with your states laws on the matter.

each state is different, but if you have proof you can serve an expedited eviction notice...in AZ its called "Material Non-compliance Notice." and they have 10 days to move out.....The court will expedite the eviction hearing if you can prove illegal activity.

google your state and landlord/tenant laws and criminal activity...that should spell out your eviction procedure exactly.

You can try and call the cops, but unless you have actual proof buying drugs all you have is hearsay and likely police will not move on it,

If month to month just give month notice without reason and get them out, if they find out you try and call the police on them and the police do nothing get ready to have your place destroyed

Until you have proof it is only your desire to ask them to leave until the 30 days is up. States don't tolerate it and can be strict but, they can counter sue and without evidence you can only wish they leave. I found my place through a community services agency and they very much dealt with tennent rights.

Yep, call the cops. Tenants aren't protected when they break laws.

The police will clear them out before you close.
Then you can buy a property that has no income stream....at least temporarily. Maybe you can pay less because of that.
