In most places, you are. I went through this before. check my question titled "Should I cut this tree down?" and the answers I received. Here is the answer I chose as "B.A.":

Your neighbor has a legal right to remove anything growing over his property line and can come after you for compensation. If it would kill the tree, it's probably best to cut it down. Here is a good website to read about property rights pertaining to trees:

I would say that the owner of the property the tree is growing from is responsible for any mass damages resulting from the tree and would be responsible for the total removal of the tree, if the owner of the property the tree is on desires to have the tree removed.

However, if the branches hang over into a neighboring yard, I'd say that the neighbor would be responsible and completely at rights to remove any limbs that were interfering with the use of the property, and any pruning of the overhanging part of the tree for appearance's sake.

But that's just my common-sense take on the issue, with no real legal standing.

depends, there is one tree on every property that has to be there, this tree belongs to the government, if it is not this tree, it is the owner of the property who must trim it

You are responsible for the part on your property but must request the permission of the person who owns it. If they refuse, you can trim it and send them the bill. :O)

the tree owner is allowed to trim it, but you are also allowed to trim back the portion that overhangs your property
