But here is the thing, they let someone go at the end of last week, at the same time they told me that my job is ending at the end of the year, and told me that they are being extremely genourous.
But the kicker is they have me sit around ALL DAY doing nothing, doesn't it sound like they are trying to push me out so that they don't have to pay unemployment. My question I suppose is there any rights out there or is there someone that I can report this too. I believe they just want to get out of unemployment, figuring that I will just get bored and leave.
Please some advise; what can I do!

This is to the guy (Old Faurt) that thinks he has all the questions. FYI, do not presume me to be some young un educated person. I am a respected adult and I do hold my own, perhaps if you are unable to offer advise that is useful you should consider going elsewhere then yahoo answers. People don't like to be riduculed when they are inquiring for advise from someone who thinks they have all the answers.

What they are doing is completely legal and nothing to worry about. Each individual state unemployment agency has its own rules on establishing whether or not a claimant will receive benefits. If you quit for no reason then you will probably not get benefits. If you quit for a GOOD reason (often referred to as "constructive discharge" as in the case of someone quitting because they are being sexually harassed and the company is doing nothing about it, etc) then you just might get benefits. If you are laid off there is a 99.9% chance of receiving unemployment benefits. Definitely ride it out! And this is coming from someone in HR that routinely fights unemployment claims by the way! :)

Heck stick it out. If they lay you off or fire you then yes you can collect unemployment. But if you quit then you would be able to even though they told you your position was ending. When they need you to do something then follow through. Go around & get references from co-workers (people in upper positions that you have worked with), start getting the word out that your available, clean up your resume and use up any sick time you may have left. Most companies don't do a pay out on left over sick time but they do on the vacation time so let them cut you the extra check for it upon departure.
It wouldn't be beneficial to you to report it because what would you do if say they change their mind and then treat you like crap. Then they really will be forcing you to leave thus not getting unemployment. Plus departing on bad terms and unable to use them as a reference would also be bad for you. Let it roll off your back.

If they are being "generous" and letting you sit around all day until the end of the year, at which time they are laying you off... then stick it out. Don't quit!!! Take that time to polish your resume and do a job search... if you have sick time, use it. If you have vacation time... use that too...find out what your company's policy is about paying out unused sick or vacation time... you've gotta be smarter than they are... THEN if they do lay you off before the end of the year - or even at the end of the year - you should be able to go and collect unemployment benefits. Good luck and thank your lucky stars that they don't expect you to pack up boxes and do a bunch of heavy lifting before your job is over!!

Wait & get your retrenchment pay.
I was retrenched in August 2002 myself. 4.5 years after, I would say losing my job was the best thing that happened to me.
Now I am into MLM...Found something I really like to do. Working less hours but earning more money than being employed.
I recommend this website www.network-marketing-works.com in case you want to explore it as an option.
