I lived in Miami with a woman that falsely accused me of battering her and her child whom i believe to be my daughter. I was put in jail for months until my family found out. Now, out on bail I went to my father's house to find that she moved to the same town!!! This lady is not a t all trust worthy so If I file a restraining order she'll find out where I am... Should I do it?? Would I get in trouble??

U should've gotten a lawyer to begin with. This woman sounds like she's out to get u. Filing for restraining order is a double edged sword because it's very possible for her to get your address from it. I think it's more bother than it's worth and it doesn't work all the time anyway. Better to just keep a low profile until she actually goes after u, then u can file for harassment charges.

If you feel unsafe, then by all means file for a protective order against her. Florida is a bad place to be legally as law enforcement here convicts you without concrete evidence and once in trouble here, youre always guilty no matter what. So if your ex wants to charge you again youre going back to jail. Florida crosses the line in many areas, so you may want to leave here to survive. I seriousily doubt your ex will ever let you see your daughter without causing you great trouble. Good luck

You can attempt filing a restraining order but you may not be able to. It sounds like you should actually hire a lawyer to assign a DNA test to find out if the child is yours. Sounds like a lot of legal drama, if you ask me.

The thing about restraining orders is -how well the police in your area enforce them. Cause if you go around her you are in violation of your own order just like if she comes around you(and you dint have one on her), she is in violation of hers. If the prosecutor in your area decides to prosecute you could both go to jail. As far as finding out where you are--if she doesn't know and hasn't contacted- why would you want one.

Moving to your town isn't enough to get a restraining order against her unless there's more to this story.

File a restraining order if you think she'll try something. Or seek legal advice if you think you'll get in trouble.

Are you afraid of her? If not, I don't believe that there's any ligit reason to get a restraining order. She's no longer a problem. If she becomes one, then deal with it in whatever way you feel appropriate. (this excludes murdering her! lol)
