I own a Lexus RX330. I took my car to the service dept. for oil change. They told me to come back in 2 hours. When I went back to dealer after 2 hours, they said my car isn't ready. I waited 1 hour and they told me my car was taken by other customers as loaner car! They were returned after 2 hours, but the dealer wouldn't apologize. I contacted Lexus headquarters, and the department specialist says that they cannot force dealer to apologize to me.
What legal actions may I take to get the apology from dealer and emotional distress?

I sincerely thank all of you for your advice. Just to let you know, (so that you don't shop at the dealer or take your Lexus for service to this dealer) the name of the dealer is Jim Falk Lexus of Beverly Hills.
Surprised? Who would thought they the guyz at Bev Hills would do such things???
I reported this matter to Better Business Bureau. I will see what they can come up with, and If I still don't get any results, I will definitely find legal remedies.

And I got a phone call from supervisor in Lexus headquarters, he said "Why do you make a big deal out of a MISTAKE?" and that's exactly what dealer guys said. I think they are trained to say that whenever these things happen.

That is theft by unauthorized taking or transfer on the part of the dealership. (The customer is an innocent bystander, but good witness.)
Seek legal advise this dealer needs to be exposed as a car thief and fraud.
Your losses are the value of your Lexus as a rental car (don't laugh they are high end rentals) the unauthorized wear and tear on your car (again use car rental mileage rates) and the emotional distress caused by not knowing who had your car or what they were doing with it.
You may also wan to file a complaint with the better business bureau on both the dealer and Lexus (Lexus has clauses in their franchise agreements to prevent customer abuse.)
Go to Lawyersandsettlements.com for a referral or contact a local lawyer (or more if you don't get one outraged over this.)
By the way where was this? I want to make sure I never buy a car from those crooks.

I'll give you an answer in a legal frame-of-mind, not hearsay or opinion. Take the car back. Whatever you put down in cash, get that back. The car belongs to the DEALER until the lender signs off on the loan. This is noted in your contract. The dealer did what is called a "spot delivery" based upon an educated guess on your credit worthiness, down payment, and other factors such as employment. Although 2 months is indeed a long time, it's no trick. The lenders they tried simply did not agree to financing you. If you try to keep the car, they'll come get it. Don't hide the car, don't try to "play hardball", etc... it won't work. Again, the car belongs to the dealer. You have no legal claim to the vehicle at all. I always love the "dealer's trying to screw you over" conjecture. The dealer wants to sell you a car and make it as painless as possible so they can move on. Nothing about this would benefit the dealer at all. They make money off the car, they make money off the loan. If the deal falls through, they get a car back with more miles... that's it. Take the car back, get your downpayment back. Nothing more to it. **ADD -- Karl, there is nothing for the dealer to accept... the buyer is in no legal position to demand anything. Once a deal is submitted to the lender, it is returned back to the dealer with one of three answers: accepted as written, denied outright, accepted with contingencies. If accepted as written, everyone's happy. If accepted with conditions/contingencies, those are either met by the buyer or the car comes back. There is no game here, it's common practice. I admit 2 months (if we take the asker at face value) is a long time, but it's not unheard of.

This seems nuts. Get a lawyer. Although, it is going to be very difficult for you to prove that the dealer did hand out your car as a loaner.

Forget the emotional distress stuff. Contact the lexus area representative and demand satisfaction. If not, tell him your lawyer will take over.

u can take them to court and sue them because noone can loan your car without your permission if they would of wrecked it you would of beent the responsible party even though u had no idea so take them to court and tell the judge u would of settled for an apology but they wouldnt even be civil and talk to you for that and now u want something done if they did it with your car imagine how many other ppl have that done to them without knowing i would also call the better buisness burreo and turn them in for it. best of wishes and good luck.

you may be able to charge them with unauthorized use of your car. I would think the dealer would do anything within reason to placate you. The manufacturer has no authority over how a dealer operates his own business.
