Small claims such as this should be kept within the family, go around to see him and if he won't pay up, give him a good hiding, then tell him he has just paid the equivalent of a fiver off his debt, you will be back next week for the rest... brothers understand this sort of treatment and I'm sure he will be only too happy to pay yopu the rest of the cash... If on the other hand you have to go back to see him again, take some staff with you - as witnesses of course.

That is pretty annoying.
The first reasonable thing is to talk to him, which you say you have tried with no success.
The next is to write to him, if you have his address. Remember however cross you are to be polite but straight, reminding him of your circumstances and previously shared responsibilities.
I have a hint that you weren't on best terms when you stopped living together - if you can't talk your only recourse is the small claims court or a solicitor.
To be honest it seems to high a price to pay for not getting on with your brother. I know they're annoying - I annoy mine too - but we do care for each other as long as we don't have to live under the same roof.
If he really is that much of a bastard it's no loss and worth any price to be rid of him.
You do the sums.

Do his girlfriend and call it even.
Or approach him in person and make him go to the bank with you and withdraw the money.
If you don't have any documented proof that you ever paid part of the deposit, then it would be difficult to take legal action. However, if there is a check written by you to the landlord or to him noting it is for the deposit, then take him to small claims court. You might only have to threaten it to get him to fork it over.

Let it lie and don't do anything legally to get back the money. some things are so much important than money. I'll presume you have good health, (another) roof over your head, food on your plate and a brother (b**d though he may be). If he won't divvy up the money with you now, consider that point in future financial dealings with him.

Small claims court if you have evidence of all of this on paper. No evidence try Judge Judy. I sympathise, my brother is a bastard as well, shame I don't have any evidence of the money he owes me!

Basically, you will have to eat it, unless you want to drag him through small claims court. This is time consuming. If it isn't a large amount of money, don't rent with him again and forget it. Move on.
